GENERAL TERMS AND CONDITIONS FOR USING THE SERVICES AVAILABLE THROUGH THE NLBEAUTY.COM WEBSITE AND RELATED MOBILE APPLICATIONS

"User", "you", or "your" refers to any person who accesses or uses the Services, including for purchasing products, browsing, publishing content, or viewing information and images.

"Services" refers to any and all services that NL BEAUTY LTD, through the Website, may offer to Users.

"User Account" means a dedicated section of the Website containing information about the User, required by NLBEAUTY.COM during registration. Access to the User Account is obtained by entering an email address or phone number and password.

By creating a User Account, you agree to receive communications related to the Website. For example, you may receive our email newsletter, from which you can unsubscribe at any time.
4. SHOPPING
NLBEAUTY allows visitors to shop through the Website.
Purchases can be made in the following ways:
4.1 With a registered User Account
Order information includes the ordered products, the customer’s name, contact phone number, and delivery address. By registering, the customer expressly agrees to these Terms.
4.2 Without registration
Order information includes the ordered products, the customer’s name, contact phone number, and delivery address. Acceptance of these Terms is required for every order.
4.3 Quick Order / Phone Order
Orders may also be placed by phone. Order information includes the ordered products, the customer’s name, contact phone number, and delivery address.
4.4 Order Cancellation
The buyer has the right to cancel an order at any time before it has been dispatched for delivery. In such case, the sales contract will be considered terminated.
5. RIGHT OF WITHDRAWAL
The User has the right to return purchased goods within 14 days, in accordance with EU law, specifically the Consumer Protection Act, Directive 2011/83/EU.
In the event of withdrawal, the amount paid by the buyer will be refunded in full within 7 business days.
To be eligible for return, the product must be unused and in its original intact packaging.
The buyer is responsible for the return shipping costs.

6. PAYMENTS
Payments for purchases made through the Website are processed exclusively via Postal Money Transfer (PMT).
7. CHANGES TO THE TERMS
NLBEAUTY.COM may modify, amend, or update these Terms from time to time at its sole discretion.
It is your responsibility to periodically review these Terms and ensure that you remain in compliance with them. Continued use of the Services after such changes or amendments shall be deemed as explicit acceptance of the revised Terms and your agreement to be bound by them.
8. TRANSLATION OF THE TERMS
NLBEAUTY.COM may provide translations of the English version of these Terms into other languages.
You understand and agree that such translations are provided solely for your convenience, and that the English version shall govern your relationship with NLBEAUTY.COM.
In the event of any discrepancies between the English version and any translated version, the English version shall prevail.

• you have not been paid or otherwise compensated for posting the review
• you have no financial, competitive, or personal incentive that would influence your review

9.2 Use of Your Content
By posting Your Content, you irrevocably grant us a perpetual, irrevocable, non-exclusive, royalty-free license to use such content within the territory of the European Union. This license includes the right to sublicense and transfer.

• translate
• reformat
• include in advertisements or promotional materials
• create derivative works
You also grant us the right to use the name or username associated with your Content.
You irrevocably waive any claims related to moral rights against us, our users, or third parties in connection with Your Content.

As between you and NLBEAUTY.COM, you retain ownership of Your Content.

• interactive features
• graphics
• design
• databases containing user content
• computer code
• products and software
• aggregated user ratings

You may not:

• distribute
• create derivative works
• publicly display
• exploit

16. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless us, our licensors, licensees, distributors, agents, representatives, and other authorized users, as well as the retailers, distributors, suppliers, and service providers of the aforementioned parties, including their directors, owners, employees, agents, representatives, and successors, from and against any and all losses, damages, liabilities, and expenses (including settlement costs and any legal or other fees and expenses related to investigation or defense of any actions) incurred by the aforementioned parties in connection with any claims arising from any breach of these Terms by you or claims arising from your use of the Website and/or your User Account.
You agree to cooperate in our defense against any such claims. We reserve the right, at our own expense, to appoint separate legal counsel and assume exclusive defense and control of any matter subject to indemnification by you. 16.1 DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NL BEAUTY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES THAT:
(i) the Services available on or through the Website are merchantable or fit for a particular purpose;
(ii) the Services available on or through the Website will operate uninterrupted or error-free;
(iii) defects will be corrected;
(iv) the Services are free of bugs, viruses, Trojan horses, or other harmful components that may be transmitted to or through the Services as a result of actions by third parties;
(v) the security methods used will be sufficient to protect the Services and their users; and

The maximum total liability for losses and damages incurred by you in connection with the use of the Services shall be limited to the greater of the amount paid by you to NLBEAUTY.COM for access to the Website and Services or 50 EUR.
NLBEAUTY.COM shall not be liable for:
(i) indirect, special, incidental, punitive, or consequential damages;
(ii) lost profits or actual losses;
(iii) business interruption;
(iv) reputational damage; or
(v) loss of information or data.
17. DISPUTE RESOLUTION
17.1
You agree that any and all disputes and claims arising out of or in connection with these Terms, the Website, or the Services shall be resolved individually, without resorting to any form of class action.
17.2
Any and all claims, judgments, and awards shall be limited to the greater of the amount paid by you to NLBEAUTY.COM for access to the Website and Services or 50 EUR, but under no circumstances including attorney fees. Under no circumstances may you recover punitive, incidental, consequential, or other damages beyond the value paid for the use of the Services of NLBEAUTY.COM.
17.3
These Terms, as well as any rights and obligations arising from them, shall be governed by the laws of the Republic of Bulgaria. Any disputes between the Parties arising from this Agreement shall be reviewed and resolved by the competent Bulgarian court.
18. SEVERABILITY
If any part of these Terms is found to be unlawful, invalid, or for any reason unenforceable, that part shall be deemed severable from the remaining Terms and shall not affect the validity and enforceability of the remaining provisions.
19. TERMINATION
19.1
You may terminate the Terms at any time by closing your User Account, discontinuing your use of the Website, or providing NLBEAUTY.COM with a notice of termination.
19.2
We may close your User Account, suspend your ability to use parts of the Website and/or completely block your access to the Services, with or without reason, without notice or liability. Such action may prevent you from accessing the Website, your Content, NLBEAUTY.COM Content, and/or other related information.
19.3
In the event of any termination of these Terms, whether by you or by us, the provisions of Sections 2, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, and 17 shall remain in full force and effect, including our right to use your Content in accordance with Section 6.

20.1

If any provision of the Terms is found to be unenforceable or invalid, only that provision shall be modified to reflect the intent of the parties or removed so that the Terms continue in full force and effect.
